Representatives Tom Cole (R-OK-04) and Sanford Bishop (D-GA-02) have introduced legislation that would fill the gaps left by the FDA’s rules on e-cigarettes and require common sense regulations that will restrict youth access to vapor products.
The Cole-Bishop Amendment would ban self-service displays in stores, would ban the sale of vapor products in vending machines and kiosks, would require warnings like “Keep out of Reach of Children” and “Underage Sale Prohibited” on all labels, and would restrict print advertising to publications only marketed to adults. In addition, the bill would strengthen FDA enforcement by mandating that all retailers register with the FDA.
The Cole-Bishop Amendment will not only protect children by restricting youth access and exposure to marketing, it will also provide strict standards for product safety in order to ensure the well-being of all adult consumers. Because the FDA continues to put consumers at risk from injury by battery explosion or fire by imposing unreasonably high hurdles that prevent any vapor products with enhanced safety features or modifications into the market, Cole-Bishop is the responsible way forward.
